General Terms and Conditions Rambler Restart B.V.
Version: September 2026
Article 1 – Definitions
In these general terms and conditions the following definitions apply:
Rambler: Rambler Restart B.V., established at Vlotlaan 507, 2681 TW Monster, the Netherlands, trading under, among others, the trade names Rambler, Rambler Company and Rambler Walking Wagon.
Customer: any natural person or legal entity that enters into or intends to enter into an agreement with Rambler.
Consumer: a natural person who acts for purposes that fall outside his or her business or professional activity.
Business customer: a natural person or legal entity that acts in the exercise of a profession or business.
Agreement: any agreement between Rambler and the customer regarding the supply of products and/or services.
Website: the website ramblerwagons.com and any other websites or webshops used by Rambler.
Article 2 – Applicability
- These general terms and conditions apply to all offers, quotations, orders and agreements of Rambler.
- These terms and conditions also apply to orders placed with Rambler via the website, email, telephone or in any other way.
- General terms and conditions of the customer do not apply, unless Rambler has expressly agreed to their applicability in writing.
- Deviations from these general terms and conditions are only valid when they have been agreed in writing or by email between Rambler and the customer.
- When a provision of these general terms and conditions proves to be wholly or partly null and void, voidable or otherwise unenforceable, the remaining provisions remain in full force.
- For consumers, the mandatory statutory consumer rights always apply. If a provision of these terms conflicts with this, the applicable statutory regulation prevails.
Article 3 – Offer and product information
- Rambler strives to present its products, specifications, images, colors, prices and other information as completely and accurately as possible.
- Images serve as illustration. Colors and certain product details may, due to among other things screen settings, product improvements or production differences, deviate to a limited extent from reality.
- Obvious mistakes, typing errors, printing errors and evident errors in prices, specifications or other information do not bind Rambler.
- An offer is valid as long as it is stated on the website or as long as the validity period stated in the offer runs, unless stated otherwise.
- Offers and orders are subject to availability.
Article 4 – Formation of the agreement
- An agreement is formed after the customer has placed an order and Rambler has accepted this order.
- For an order via the webshop, the customer generally receives an electronic confirmation of the order.
- An agreement may also be formed following a quotation, order confirmation or order by email or telephone.
- Rambler reserves the right to refuse an order or attach additional conditions to delivery when there is a reasonable ground for this, for example in the case of payment risk, suspicion of fraud or insufficient availability of the product.
- For consumers, the statutory right of withdrawal as described in Article 13 applies to distance agreements.
Article 5 – Prices
- The prices shown on the consumer website are, unless expressly stated otherwise, inclusive of VAT.
- Prices in business quotations or price agreements may be stated exclusive of VAT. This is clearly indicated in that case.
- Any shipping, transport or other additional costs are made known before the agreement is concluded.
- All prices are in euros, unless another currency has been expressly agreed.
- Rambler has the right to change its prices. A price change has no effect on an agreement already formed, unless the parties expressly agree otherwise or the law permits this.
Article 6 – Payment
- Orders via the webshop are paid using one of the payment methods offered.
- If Rambler agrees payment on account with a customer, the payment term stated on the invoice applies. If no other term has been agreed, this is 14 days after the invoice date.
- A business customer who does not pay within the agreed term owes the applicable statutory commercial interest from the moment of default.
- For consumers, the applicable statutory rules apply with regard to payment arrears, interest and collection costs.
- Reasonable out-of-court collection costs may, insofar as legally permitted, be charged to the customer when a due payment obligation is not met on time.
- In the event of bankruptcy, suspension of payment, liquidation or a comparable situation, outstanding claims of Rambler may, insofar as legally permitted, become immediately due and payable.
Article 7 – Delivery
- Orders are delivered to the delivery address provided by the customer.
- The customer is responsible for providing the delivery address and the necessary contact details correctly and completely.
- Stock products are in principle shipped within the term indicated on the website, quotation or order confirmation.
- When a product is not directly available from stock, Rambler informs the customer as soon as possible about the expected delivery term.
- If products from one order have different delivery times, Rambler may deliver the order in multiple shipments. Any additional shipping costs are not charged to the customer without prior agreement.
- Stated delivery dates and delivery times are indicative, unless it has been expressly agreed in writing that it concerns a strict deadline.
- For consumers, the statutory rules regarding delivery and delivery times also apply.
Article 8 – Transport and risk
- On delivery to a consumer, the risk of loss or damage of the product in principle passes to the consumer as soon as the consumer, or a third party designated by the consumer who is not the carrier, has received the product.
- For business customers, the risk passes at the moment as agreed in the quotation, order confirmation or applicable delivery condition. When nothing has been agreed about this, the risk in principle passes upon delivery to the business customer.
- When a shipment cannot be delivered due to an incorrect or incomplete address provided by the customer, or when a shipment is not accepted or collected after several delivery attempts, the reasonable costs of a new shipment may be charged to the customer, insofar as legally permitted.
Article 9 – Shipping and transport costs
- Rambler uses parcel services, carriers and logistics service providers for shipping and delivery.
- The shipping or transport costs depend on, among other things, the product, weight, volume, number of packages, delivery address and country of destination.
- The applicable shipping costs are shown where possible during the order process or stated separately in the quotation or order confirmation.
- For larger Rambler models, pallet shipments and international deliveries, different transport rates may apply.
Article 10 – Retention of title
- Insofar as legally permitted, delivered products remain the property of Rambler until the customer has paid in full all amounts due in respect of the relevant agreement.
- The customer may not sell, pledge or otherwise encumber products subject to retention of title, except insofar as this takes place in the normal course of its business activities and it has been agreed otherwise in writing.
Article 11 – Inspection after receipt
- The customer is requested to check the order for completeness and any visible transport damage as soon as possible after receipt.
- Any damage, missing parts or incorrect deliveries can be reported via contact@rambler.company.
- Not immediately reporting a defect does not affect consumers' statutory rights.
- Business customers must report visible defects or deviations to Rambler within a reasonable period after receipt.
Article 12 – Cancellation before shipment
- If you wish to cancel an order before it has been shipped, please contact Rambler as soon as possible at contact@rambler.company.
- When the order has not yet been processed or shipped, Rambler will try to cancel the order free of charge.
- If an order has already been shipped, the provisions on the statutory right of withdrawal as included in Article 13 apply to consumers.
- For products specially ordered, produced or modified for the customer, different cancellation conditions may apply, insofar as legally permitted.
Article 13 – Right of withdrawal for consumers
- A consumer who buys a product at a distance in principle has the statutory right to withdraw from the agreement without giving reasons within 14 days.
- The withdrawal period starts on the day after the consumer, or a third party designated in advance by the consumer who is not the carrier, has received the product.
- For an order consisting of several products delivered separately, the withdrawal period starts on the day after receipt of the last product, insofar as the law prescribes this.
- To exercise the right of withdrawal, the consumer must unambiguously inform Rambler within the withdrawal period of his decision to withdraw from the agreement. This can be done, among other things, via contact@rambler.company or via the functionality available for this on the website.
- After withdrawal, the consumer has another 14 days to return the product.
- The direct costs of the return shipment are for the account of the consumer, unless Rambler has expressly indicated that it will bear these costs or the law provides otherwise.
- Because Rambler wagons may, due to their size, not be returnable by regular parcel post, the return costs may be considerably higher than for a standard parcel. Rambler informs the consumer before purchase about these costs or a reasonable estimate thereof when this is legally required.
- The consumer may inspect and assess the product as would reasonably be possible in a physical shop. The consumer is liable for any decrease in value resulting from handling that goes beyond what is necessary to establish the nature, characteristics and functioning of the product.
- In the event of full withdrawal, Rambler refunds all payments received from the consumer in respect of the relevant order, including the costs of standard delivery to the consumer. Any additional costs for a more expensive delivery method chosen by the consumer are not refunded.
- Refund takes place within 14 days after Rambler has been informed of the withdrawal. Rambler may wait to refund until the product has been received or until the consumer demonstrates that the product has been returned, whichever comes first.
- Refund takes place using the same means of payment with which the original payment was made, unless expressly agreed otherwise.
- The statutory right of withdrawal does not apply when a statutory exception applies, for example for products made according to the consumer's specifications and clearly intended for a specific person or customer, insofar as the statutory conditions for this exception are met.
Article 14 – Exchange
- When a consumer wishes to exchange a standard product for another product, contact can be made with Rambler about this.
- When the exchange takes place within the statutory withdrawal period, the consumer's statutory rights remain fully applicable.
- Any price differences between products are settled with the customer.
- For business customers, exchange only takes place after prior written consent from Rambler.
Article 15 – Statutory warranty and additional Rambler warranty
- For consumers, the statutory warranty always applies. This means that a product must comply with what the consumer may reasonably expect of it on the basis of the agreement and the law.
- The statutory warranty is not limited by any additional commercial warranty of Rambler.
- In addition to the statutory warranty, Rambler offers, unless stated otherwise with the product, an additional commercial warranty of:
2 years on the frame;
1 year on other parts, with the exception of parts subject to normal wear.
- This additional warranty applies from the original date of purchase.
- The additional warranty relates to material and construction defects under normal and prescribed use.
- Normal wear does not fall under the additional warranty. Depending on use and circumstances, this may include, for example, tires, inner tubes, brake parts, bearings, fabric parts and other wear-prone components.
- The additional commercial warranty may not apply when the defect is demonstrably the result of:
- incorrect assembly;
- unauthorized changes or modifications;
- an accident or external damage;
- incorrect, careless or improper use;
- insufficient or incorrect maintenance;
- use contrary to the manual;
- damage due to moisture, fire, lightning strike or other external causes.
Normal professional use of Rambler products by childcare organizations, schools and comparable institutions is not in itself regarded as excluded commercial use.
If a warranty claim is justified, Rambler will, depending on the circumstances, provide free repair, replacement of the defective part, replacement of the product or another suitable statutory solution.
To report a warranty claim, contact can be made via contact@rambler.company. Rambler may request a proof of purchase, photos, serial number and/or other reasonably necessary information to assess the claim.
Article 16 – Maintenance and repair
- For safe operation and a long service life of Rambler products, regular maintenance is necessary.
- The customer must follow the maintenance and use instructions from the manual belonging to the product.
- Maintenance may, depending on the work, be carried out by the customer themselves or by a suitable professional.
- Repairs that do not fall under statutory or additional warranty may, after consultation, be carried out or facilitated against payment.
Article 17 – Complaints
- If the customer has a complaint about a product, order or service, it can be submitted via contact@rambler.company.
- Complaints are handled as soon as possible. Rambler strives to give an initial substantive response or confirmation within 5 business days.
- If more time is needed to investigate a complaint, Rambler informs the customer about this.
- Consumers are requested to report a defect within a reasonable period after discovery. A report within two months of discovery is in any case regarded as timely.
- The customer must, insofar as reasonable, give Rambler the opportunity to investigate a defect and offer a suitable solution.
Article 18 – Liability
- Rambler is liable for damage insofar as this liability arises from the applicable legislation or the agreement.
- Nothing in these general terms and conditions limits or excludes liability where such a limitation or exclusion is not legally permitted.
- For business customers, Rambler's liability for indirect damage, including consequential damage, lost profit, missed savings and business interruption, is excluded insofar as legally permitted.
- Rambler's liability towards business customers is, insofar as legally permitted, limited to the amount paid out in the relevant case by Rambler's liability insurance. If, for whatever reason, no payment is made, liability is limited to the invoice amount of the agreement to which the liability relates.
- The aforementioned limitations do not apply in the event of intent or deliberate recklessness by Rambler or when limitation of liability is not permitted under mandatory law.
Article 19 – Force majeure
- Rambler is not obliged to fulfill an obligation when fulfillment is temporarily or permanently impossible as a result of a circumstance reasonably beyond its control.
- Depending on the circumstances, this may include, among other things: natural disasters, fire, war, government measures, strikes, epidemics, serious disruptions of transport or logistics, disruptions at suppliers, ports or carriers, and other circumstances over which Rambler can reasonably exercise no influence.
- Rambler will inform the customer as soon as possible when such a situation has significant consequences for the performance of the agreement.
- The statutory rights of consumers remain fully applicable in this respect.
Article 20 – Intellectual property
- All intellectual property rights in, among other things, the website, texts, photos, images, product designs, manuals, trade names, trademarks and other material developed or published by Rambler rest with Rambler Restart B.V. and/or its licensors, unless stated otherwise.
- Without prior written consent it is not permitted to copy, publish, use commercially or otherwise exploit this material in whole or in part, except where this is legally permitted.
Article 21 – Privacy
- Rambler processes personal data in accordance with the applicable privacy legislation.
- Information about the processing of personal data, the use of cookies and the rights of data subjects is included in Rambler's current privacy policy on ramblerwagons.com.
- Personal data may, insofar as necessary for the execution of an order or service, be shared with, among others, payment providers, logistics service providers, fulfillment partners and carriers.
Article 22 – Website and information
- Rambler takes great care over the accuracy and topicality of the information on its website.
- Nevertheless, errors, incompletenesses or outdated data may occasionally occur.
- Obvious errors or mistakes do not bind Rambler.
- Rambler may change the content of the website when this is necessary or desirable.
- Rambler is not responsible for the content of third-party websites referred to from its website, insofar as the law permits such an exclusion.
Article 23 – Applicable law and disputes
- Dutch law applies to agreements with Rambler.
- The Vienna Sales Convention (CISG) is excluded, insofar as this exclusion can be validly agreed.
- Disputes are submitted to the court that has jurisdiction under the law.
- For consumers, a choice for Dutch law does not affect the mandatory consumer protection to which the consumer is entitled under the law of the country in which he or she habitually resides, when this protection applies under applicable international rules.
Article 24 – Amendment of the general terms and conditions
- Rambler may amend these general terms and conditions from time to time.
- For an agreement already concluded, the version of the general terms and conditions that applied at the time the agreement was concluded in principle applies, unless the parties validly agree otherwise.
- The most current version of the general terms and conditions is published on ramblerwagons.com.
